I.⁠ ⁠Usage and Rental Period 

Electric scooters and e-bikes are charged based on an unlocking fee and per-minute usage, starting from the moment the scooter is unlocked via the VIBES app until it is locked and returned to an approved docking station.

Riders are required to return electric scooters and e-bikes to designated zones shown in the app. Failure to comply may result in additional fees. 

 

II.⁠ ⁠User Responsibilities 

• Compliance: Riders must obey all local traffic laws and operate electric scooters and e-bikes in a safe and lawful manner. 

• Inspection: Users are responsible for inspecting the scooter before use. Any damages or issues must be reported via the app before riding. 

• Safety Gear: Riders are encouraged to wear helmets and other protective gear. 

• Restricted Activities: Riders must not: Operate electric scooters and e-bikes while under the influence of alcohol or drugs. 

• Use electric scooters and e-bikes for stunts or off-road riding. 

• Carry passengers or exceed the weight limit (maximum 220 lbs).

III.⁠ ⁠Payment and Fees 

• Fees are calculated based on total minutes of usage as tracked by the VIBES app. 

• Additional fees may apply, including but not limited to: 

• Improper Parking: $25–$50. 

• Damage or Theft: Users are responsible for up to $500 for repair or replacement. 

• Abandoned electric scooters and e-bikes: $50 retrieval fee.

IV.⁠ ⁠Battery and Availability 

Electric scooters and e-bikes are available on a first-come, first-serve basis.

Battery levels may vary, and riders should verify charge levels in the app before use. VIBES is not liable if a scooter runs out of power during a ride. 

 

V.⁠ ⁠Assumption of Risk and Liability 

By using VIBES, riders acknowledge and accept the risks associated with electric scooter use, including potential injuries or property damage. VIBES is not responsible for accidents or injuries caused by user negligence. 

 

VI.⁠ ⁠Indemnification 

Users agree to indemnify and hold VIBES harmless from any claims, damages, or expenses (including legal fees) arising from their use of the electric scooters and e-bikes. 

 

VII.⁠ ⁠Termination of Use 

VIBES reserves the right to terminate rentals or deactivate user accounts for: Unsafe or reckless behavior.  Violation of terms and conditions. 

 

VIII.⁠ ⁠Privacy Policy 

VIBES collects location and usage data to improve services. Personal information will not be shared with third parties without consent. 

 

IX.⁠ ⁠Governing Law 

This agreement is governed by the laws of the United States of America and the U.S. Virgin Islands. 

 

X.⁠ ⁠Dispute Resolution 

Any disputes will be resolved through binding arbitration in accordance with Unites States of America and Unites States Virgin Islands regulations.
